Businessman docked over container-load of fake, banned drugs







A businessman, Ezeanwu Ifeanyi who allegedly imported a container loaded with fake and banned drugs was, yesterday, arraigned by the National Agency for Food and Drugs Administration Control, NAFDAC, before a Federal High Court sitting in Lagos.

NAFDAC prosecutor, Mr. Umar Shamaki, alleged that the defendant, a resident of Rumak Street, Satellite Town, Ojo, Lagos, was found in possession of a 40-foot container loaded with Tramadol Hydrochloric tablets, 225mg; Tramadol tablets, 250mg; Royal Tramadol, 225mg; Ibamol tablet, 50mg; Heogra tablet, 150mg and Diarrhoea capsule. According to the prosecutor, the offence committed is contrary to section 1(a) of the Counterfeit and Fake Drugs and Unwholesome Processed Foods (Miscellaneous Provision) Act Cap. C34 Law of the Federation of Nigeria, 2004, and punishable under Section 3(1) of the same Act.

However the defendant pleaded not guilty to the charge. In view of his plea, the prosecutor, Mr. Shamaki, asked the court for an adjournment and also urged the court to remand the defendant n prison custody, pending trial. However, the defendant’s lawyer, Mr. Chinwobi Adiele, urged the court to order the prosecution to oblige him with the proof of evidence. He also told the court that his client’s bail application is pending before the court and was served the prosecution.

Responding, the prosecutor informed the court that he was served the application in court “this morning,” and that he needed time to respond to the application. He added that not replying the application would mean that the prosecution had admitted to the facts deposed therein. Following the submission of the prosecutor, Justice Hadiza Rabiu-Shagari, adjourned the matter till March 16, for hearing and ruling on the bail application. Justice Rabiu-Shagari, however, ordered that the defendant be remanded in prison custody pending the next adjourned date.
